Trade dress infringement suit brought by owner of Pedialyte brand in Minnesota court could hold implications for whether rivals in so-called oral electrolyte solutions (OES) space are able to more easily move into 1-liter size of square-footprint bottle that defines category in larger-format stores. Suit was brought by pharma giant Abbott Laboratories vs 7-yr-old player Revitalyte, which is small in scale tho aligned on distribution front with Monster Beverage via that co's Monster Brewing unit. (Brand was part of CanArchy Brewing portfolio when MNST acquired that co and rebranded it as Monster Brewing.) In recent filing moving for summary judgment, Revitalyte outlines its position this way: "Because Abbott's trade dress is unregistered, Abbott must overcome 'the statutory presumption' that its trade dress is functional&mdash;that it is 'essential to the use or purpose of the article' or 'affects [its] cost or quality,'" per court filing citing several legal precedents. In case, Revitalyte has amassed evidence that far from being design element intended to distinguish brand, that OES pack has served purely functional role. "No record evidence shows that it was adopted for anything other than functional reasons," per filing in US District Court. Tho it was the one that brought case, there might be significant downside for Abbott if it loses: a favorable ruling for Revitalyte might render Pedialyte&#39;s trade dress invalid or generic and therefore unprotectable, in what would be a boon for range of rivals that have been chipping away at its longstanding hegemony in OES segment. Most go out exclusively in single-serve sizes well below 1-liter.At issue is retortable 1-liter pack used that is clear and rectangular with "gently sloping shoulders" and two ribs. Abbott has argued that "modern manufacturing methods" had eliminated the functional requirement that this pack be used by rapid hydration brands. In case, Revitalyte amassed evidence of "at least 141 third-party products (that) bear all the features claimed to constitute Abbott's trade dress" and have racked up hundreds of millions in sales before and after Revitalyte's launch.Why did Abbott wait until spring 2023 to bring suit and why Revitalyte? Tho cofounders AJ Lagoo and Ryan Leonard declined to discuss suit with us, their stance seems clear from unusually assertive language of suit. Their lawyers argue that "the Lanham Act serves to protect consumers, not to enable anticompetitive, brute-force strike suits. Yet Abbott's case is precisely that: scorched-earth litigation to force capitulation from a two-person competitor by running up the tab and running out the clock."There seems a risk to Abbott, tho. If Revitalyte succeeds in getting Pedialyte's claimed trade dress on basis of functionality canceled, that would seem to invalidate any presumed claim by Abbott on that standard 1-liter OES pack, effectively clearing runway for competitors to more directly challenge Pedialyte with larger packs of type found in larger-format retailers like grocery and drug stores.Court filings imply that Abbott has not been entirely on its game. They note that pharma giant does nothing to "counter the undisputed (and embarrassing) fact that its leading competitor and former supplier of Revitalyte's 1-liter products, Perrigo/PBM Nutritionals, has for years owned a registration that covers the very same bottle Abbott claims as trade dress."
